Designer sues Anitta and demands removal of music videos on YouTube

The designer Lucia Helena da Silva, owner of the brand Ropahrara Moda Exótica, has filed a lawsuit against Anitta and the C&A network, seeking R$1 million in compensation for alleged copyright and intellectual property violations. Lucia claims that the singer used pieces from her collection without giving proper credit in two music videos: “Is That For Me” (2017) and “Vai Malandra” (2017), with the latter having surpassed 456 million views on YouTube.

Additionally, the designer’s clothing is said to have been used in C&A campaigns, advertised as creations made in collaboration with designer Yasmine McDougall Sterea. As a result, Lucia Helena is requesting the immediate removal of the videos from the platform, seeking urgent legal relief. She also demands that Google, which owns YouTube, pay R$500,000 in damages for moral harm.

It is important to note that the Internet Civil Framework, in effect since 2014, stipulates that YouTube cannot be penalized for content posted by third parties but can be held liable if it fails to comply with a court order to remove the material.
